Before you can order from us we require you to read and understand these terms and conditions. The terms and conditions should be read in conjunction with our other information pages. We have tried to make all information as clear as possible but if you have any queries please contact us.
Adding an item to your shopping cart or otherwise purchasing an item from us constitutes a confirmation that you have read, understood and agree to the following terms and conditions.
Product Information
All product information shown on the website is believed to be correct and accurate. However, we regret that we cannot be held responsible for any errors or omissions.
We cannot be held responsible for the total accuracy of the information that is published, though every effort is maintained to keep the information as accurate and up to date as possible. Therefore, all the actions taken by users of the goods obtained via the website are their own responsibility.
It is impossible to publish all the technical details of the products, therefore all descriptions and images serve to give approximate description of the product. If you have any queries we’re always happy to help.
Ordering and Delivery
You can order products from us in the following ways: i) via this website ii) by telephoning 01273 607088 iii) via Paypal iv) via electronic bank transfer. Not all the options listed are always available. Please contact us if you require help with payment processing and systems. Please do NOT send cheques.
All prices displayed on the website are in Pounds Sterling and include VAT at the current UK rate but exclude delivery charges which will be added when you checkout.
The price you pay is the price displayed on this website at the time we receive your order except in the instance where an error has occurred with the data making up the information which is projected through the website. In the event that an error is discovered with the price of any goods you may have ordered, we will inform you as soon as we can whereupon we will give you the option of amending and processing your order at the correct price or cancelling it. If you cancel and you have already paid for the goods, we will give you a full refund.
When you place an order you are offering to buy the product at the stated price. We will send you an automated email as a confirmation of your order details. This email does not necessarily mean we can meet your order.
Orders are subject to availability. All our stock levels are displayed on our website and these levels are real, live and updated throughout the day and night, 365 days a year. In the rare situation that a stock error results in an item from your order not being available, we will contact you at the earliest opportunity to discuss your options. If the product is available and the details of the order are correct, we will send you a further email specifying delivery details and confirming the price of the products purchased. This email will be deemed as acceptance of your order.
If the product is not available or the details of the order are not correct (your address for example) we will contact you by telephone, email or both.
We cannot be held responsible for sudden stock shortages or manufacturing delays.
Firetoys may cancel any sale and not supply products if it is reasonable to do so and may change or discontinue the availability of products at any time at its sole discretion. If an order is cancelled, any payment made for the products will be refunded in full. This does not affect your Statutory Rights (i.e. all the stuff you are legally entitled to as a consumer).
You take ownership of the products as soon as they have been delivered to the address detailed on your order.
Any damage to or shortage of the products in transit (i.e. with our couriers) should be noted on the delivery/consignment note at the time of delivery. Transit damages or shortages should be reported to us as soon as possible.
You should inspect your order immediately after delivery and inform us of any damage, error or fault as soon as possible.
You have the right to return any product to us for any reason within 60 days of delivery as long as it is in a resalable, “as new” condition. We guarantee all of our products to be free from manufacturing defects for 12 months. (See the Returns and Refunds page for more details on the last three points).
None of the above affects your statutory rights as a consumer.

If ordering to an address outside the EU the UK tax (VAT which is 20%) will be automatically deducted from the price of your items. On receipt of the goods you should expect to pay local import duty at your national rate, we do not have any control over these charges and they vary from country to country so we would recommend you contact someone in your area that can advise on your particular rates.
Privacy
Firetoys will not share, sell or pass on any of your details to third parties, except in some cases where we supply telephone numbers and email addresses to our couriers for the sole purpose of facilitating delivery.
We do not store any of your payment details.
Firetoys is not responsible for the content of, or information gathered by external websites from posts made on our website or social media pages.

Legal Disclaimer
Fire Props
You use fire props bought from Firetoys at your own risk. Firetoys LLC and all associated people and organisations accept no responsibility or liability for any injury, accident or death caused by any of the products supplied. It is the responsibility of the performer to take the necessary precautions and to minimize hazards.
Firetoys does not sell fire props to children under 18. If you are under 18, you should have bought these products under adult supervision and should continue using them under adult supervision at all times. A high level of proficiency should be attained with your prop before even considering the use of fire. Safety precuations should always be taken when performing with fire. A basic, but not exhaustive, set of fire safety considerations can be found here. Firetoys also recommends you also take a fire safety course from and experience and qualified instructor.
It is the your responsibility to use an appropriate fuel when performing with fire. Firetoys cannot definitively advise on the type of fuel to use due to regional and national variations. You should consult and experienced and qualified performer in your area to determine which fuel is appropriate. You should acquire a Material Safety Data Sheet (MSDS) when purchasing fuel and refer to this if you are in any doubt as to whether it is an appropriate fuel.
Fire Breathing and Eating
Fire breathing and eating are inherently more dangerous than fire prop spinning. Firetoys does NOT recommend you take up these activities. Before you decide you want to fire breathe or eat then it is your responsibility to research this artform fully and familiarise yourself with the potential dangers and safety precautions. You MUST get instruction from an experienced and qualified performer before attempting these activities.
Dangerous Items
Firetoys also stocks items such as juggling knives, throwing knives, whips and nunchucks. These are strictly sold as circus props and NOT weapons and must only be used in accordance with the safety information provided. These items are also not for sale to children under the age of 18.
You use "dangerous items" bought from Firetoys at your own risk. Firetoys LLC and all associated people and organisations accept no responsibility or liability for any injury, accident or death caused by any of the products supplied. It is the responsibility of the performer to take the necessary precautions and to minimize hazards.
Aerial Acrobatics Equipment
You use aerial acrobatics equipment bought from Firetoys at your own risk. Firetoys LLC and all associated people and organisations accept no responsibility or liability for any injury, accident or death caused by any of the products supplied. It is the responsibility of the performer to take the necessary precautions and to minimize hazards.
Firetoys has a large range of aerial circus equipment. Strict safety precautions should be adhered to when using such equipment. Some of the most important precautions include, but are not limited to:
- Professional training is essential
- Do not attempt to learn new moves from videos or books alone.
- You should never train alone.
- Rigging should be undertaken by a compentent professional. Do NOT rig from trees.
- Equipment should be inspected thoroughly before every use.

Balance Equipment
You use balance equipment bought from Firetoys at your own risk. Firetoys LLC and all associated people and organisations accept no responsibility or liability for any injury, accident or death caused by any of the products supplied. It is the responsibility of the performer to take the necessary precautions and to minimize hazards.
Balance products such as unicycles, rolla bollas, Cyr wheels and others also have an element of risk in their use. You should learn to use these products under the supervision and instruction of an experienced user. Safety equipment such as helmets for unicycling should be worn at all times.
Safety and maintenance sheets are provided with all fire, aerial and other dangerous products. These should be carefully read and fully understood before use. Should a fire or other dangerous prop be delivered without relevant accompanying paperwork please contact us as soon as possible so we can send you out the correct accompanying documentation.
Insurance
It is the user’s responsibility to purchase third party insurance before performing or teaching with fire or aerial equipment. Firetoys strongly recommends all users have proper insurance.

Illegal copying and reproduction of any materials without written consent violates international copyright law and will be pursued. Commercial websites and organisations caught using our material without permission will be invoiced in full for all materials used. Non-commercial use of our material is allowed with written permission from us and is virtually always granted as long as a link back to Firetoys.com and full credits are given.
